Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of our Terms of Use (the “Terms”) and governs the use of the GenAI Features that you may access or use in connection with our Products, Software and/or any other services and offerings.  This AUP is intended to help you use GenAI Features in a legal, safe, and responsible way and describes activities that are prohibited in connection with your use of the GenAI Features. Violating this AUP could result in action against your access to the GenAI Features, or suspension or termination as further described in this AUP and/or the Terms. 

We may update this AUP from time to time in our sole discretion. Your continued use of the GenAI Features following such update will constitute your acceptance of the applicable updates. All capitalized terms not defined herein shall have the meaning set forth in the Terms.

  1. You represent and warrant that you shall not, and shall not cause or allow any third party to:
    1. Access (or attempt to access), tamper with, reverse engineer, export, download or search any portion of the GenAI Features and/or its underlying or related infrastructures, systems, networks, servers, and technologies (“Systems”), by any means other than through the user interface that is provided by us in connection with the GenAI Features or the Systems (e.g. scraping, spidering or crawling);
    2. Probe, scan, or test the vulnerability of the GenAI Features or the Systems or breach or circumvent any security or authentication measures thereof;
    3. Attempt to disrupt or overwhelm any infrastructure for the GenAI Features by imposing unreasonable requests or burdens on our and/or our Third Party Providers’ resources (e.g. using “bots” or other automated systems to send requests to our and/or our Third Party Providers’ servers at a rate beyond what could be sent by a human user during the same period of time);
    4. Copy, modify, alter, change or create any derivative works of the GenAI Features or Systems, or any part thereof or otherwise remove proprietary marks from the GenAI Features or Systems;
    5. Use the GenAI Features and/or the Systems to transmit malware or for phishing purposes;
    6. Perform any activities or upload, submit, transmit or distribute any Input, materials or Content (as defined below) that will harm or disrupt the operation of the GenAI Features, the Systems, and/or any other infrastructure or servers of our Third Party Providers;
    7. Use the GenAI Features to perform any illegal, unlawful, fraudulent or deceptive activities or to create any products or services competitive with any of our products or services;
    8. Attempt to gain unauthorized access to the GenAI Features or the Systems to defeat, avoid, bypass, remove, deactivate, or otherwise circumvent any software protection or monitoring mechanisms of the GenAI Features or the Systems;
    9. Impersonate any person, organization or entity, or falsely state or otherwise misrepresent your affiliation with any person, organization or entity;
    10. Use the GenAI Features to violate the privacy of others, including posting private and confidential information of others, without their express authorization or otherwise permitted by them or applicable laws;
    11. Use the GenAI Features to perform or encourage others to perform any activities that are defamatory, libelous or threatening, constitute hate speech, harassment, or stalking;
    12. Upload, submit or transmit through the GenAI Features or the Systems any data, file, attachments, text, prompts, images, reports, software, links or any other content (“Content”) that contains or redirects (or may contain or redirect) to a virus, Trojan horse, worm, scripting exploits, bots or other harmful component or technology that may or is intended to damage or hijack the operation of any hardware, software (including the GenAI Features), or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component;
    13. misuse or otherwise use the GenAI Features or the Systems in an excessive manner compared to the anticipated standard of use (examined at our sole discretion), including without limitation, consuming a massive amount of storage, or otherwise burdening the GenAI Features or the Systems in a manner that impairs its operation or in violation of the documentation or other instruction and/or operational restriction designated by us;
    14. Send messages or communications which are (i) unlawful, or contain unlawful content (ii) unsolicited (including spam); (iii) mailed to purchased, scraped or rented lists; or (iv) to recipients who requested in any form not to receive messages or communications from you;
    15. Generate content (including through functionalities within the GenAI Features, such as AI functionalities) that is illegal, harmful, hateful, discriminating, threatening, violent, harassing, damaging or which encourages any such content; and/or
    16. Generate or use (including through functionalities within the GenAI Features), content which infringes any third party right.
  2. You represent and warrant that you shall not, and shall not allow, cause or encourage others, to upload, submit, prompt, input, transmit, or send, any Content to or through the GenAI Features or Systems that:
    1. Exploit or abuse children, including but not limited to images or depictions of child abuse or sexual abuse, or that present children in a sexual manner;
    2. Infringes our or any third party’s intellectual property or other rights, including any copyright, trademark, patent, trade secret, moral rights, or any other intellectual property right, including proprietary or contractual right;
    3. Infringes any privacy rights or publicity rights;
    4. Is deceptive, fraudulent, illegal, obscene, defamatory, libelous, threatening, harmful, pornographic, indecent, harassing, hateful, inducing violence and/or terrorism, or otherwise encouraging any illegal, tortious or inappropriate conduct; and/or
    5. Attacks or otherwise unlawfully relate to others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition.
  3. We are under no obligation to monitor your activities in relation to the GenAI Features or the Systems. However, we and/or our Third Party Providers may systematically screen and/or monitor any Content uploaded, submitted and/or transmitted through our GenAI Features or Systems, at any time and for verifying Your compliance with this AUP and the Terms, with or without notice.
  4. You acknowledge that it is our policy to respect the legitimate rights of copyright and other intellectual property owners, and we will remove or otherwise take down any Content that infringes or allegedly infringes copyright or any third party right.
  5. In case we suspect that your Content, any of your activities or use of the GenAI Features may be in violation of this AUP, the Terms, or applicable law, we may, upon notice to you and without liability to you (i) remove and/or block such violating Content, in whole or in part; (ii) terminate or suspend your access to the GenAI Features, or access to certain functionalities of the Products and/or our services if impacted by the access of the GenAI Features; and/or (iii) remove or limit access to Content or data you submitted to the GenAI Features or made available to third parties using the GenAI Features (if applicable).
